Colorado revised statutes C.R.S. 14-10-113 mandates that “property shall be valued as of the date of the decree or as of the date of the hearing on disposition of property if such hearing precedes the date of the decree.”

When we are talking about maintenance, the court looks to C.R.S. 14-10-114 and considers:

(a) the amount of each party’s gross income;

(b) the marital property apportioned to each party;

(c) the financial resources of each party, including but not limited to the actual or potential income from separate or marital property; and

(d) reasonable financial need as established during the marriage.

Child support looks to C.R.S. 14-10-115 and considers:

(i) the parents’ combined adjusted gross income estimated to have been allocated to the child if the parents and children were living in an intact household;

(ii) adjust the child support based upon the needs of the children for extraordinary medical expenses and work-related child care costs; and

(iii) allocate the amount of child support to be paid by each parent based upon physical care arrangements.

With parenting plans, do not go back and argue about how it “used to be.” By the time you are finalizing your divorce are likely separated and sharing time with the kids already.

You have tax returns and profit and loss statements to determine a fair and reasonable value for a business.

You have bank statements and credit card statements to help determin where the money is and went.
