DEVIATION of CHILD SUPPORT & EXTRA ORDINARY EXPENSES
In cases where the parents’ combined gross income exceeds a certain amount, or a parenting plan is negotiated with the idea that the children’s needs can be met for a lesser amount – or on a rare occasion a greater amount – the parents can ask the Court to deviate from the amount computed for the child support worksheet.
While the law holds that it is the child’s right to child support and the parents cannot contract out of support on the child’s behalf, in certain circumstances such as
– a parent’s ability to pay;
– a significantly unequal parenting time schedule;
– a child with special needs; the Court will accept a different amount negotiated by the parents or successfully argued in Court.
Sometimes kids must travel for their parenting time and those costs should be factored into the calculation and extra-ordinary expenses for purposes of child support.
Some children may have special educational or physical needs that require consideration for purposes of child support.
The parents may agree that the child is gifted and talented and certain expenses for the child’s hobby, sport, acting, dancing etc., should actually be factored into the child support worksheet.
